The photographer retains all copyrights attached to the content, as well as any other rights which may not be detailed in this agreement.
· You may create original artwork from images only within the Equine and Countryside Stock gallery, all other images on this site are strictly out of bounds.
· You may put the derivative artwork up for public or private sale and keep 100% of the proceeds.
· You may not pass on / share or otherwise distribute images from EJLazenby Photography to any other party whatsoever.
· You may not create limited or open edition prints from your derivative artwork, nor reproduce the image on associated merchandise.
· You may not claim ownership of the reference material used to create the derivative work.
· Attribution is expected when using online at all times.
· EJLazenby Photography grants the buyer the non-exclusive, non-transferable and non-assignable use of the content, with no expiry date, for the purpose of commercial usage.
· Such as; Websites; Blog posts; Social media; Advertisements; Marketing campaigns; Corporate presentations; Magazines; Product packaging.
· No Products for Resale - You are not permitted to use this content in connection with any goods or services intended for resale or distribution where the primary value lies in the content itself. Such as cards, stationary items, paper products, calendars, apparel, posters (and other printed media of this nature) DVDs, mugs, postcards, and other items of this nature.
· Permissions for use in projects outside of the above guidelines can be discussed when required.
· 'Use' means to copy, reproduce, modify, edit, display, broadcast, publish or otherwise make use of.
· The user is allowed to crop and/or electronically alter the content of an image to suit your purposes for the usage stated above.
· Attribution is expected when using online at all times.
· No False Representation of Authorship. You may not falsely represent that you are the original creator of a work that is made up largely of licensed content. For instance, you cannot create artwork based solely on licensed content and claim that you are the author.
· No “On Demand” Products. Unless you purchase a customised licence, you may not use content in connection with "on demand" products (e.g., products in which a licensed image is selected by a third party for customisation of such product on a made-to-order basis), including, without limitation, postcards, mugs, t-shirts, calendars, posters, screensavers or wallpapers on mobile telephones, or similar items (this includes the sale of products through custom designed websites, as well as sites such as zazzle.com and cafepress.com).
· No Electronic Templates. Unless you have personal written permission, you may not use content in electronic or digital templates intended for resale or other distribution (for example, website templates, business card templates, electronic greeting card templates, and brochure design templates).
· Attribution is expected when using online at all times.
· Subject to your compliance with these Terms of Use, any applicable license agreement with EJLazenby Photography, and the law, you may access and use the Site. EJLazenby Photography remains the sole owner of all right, title, and interest in the Site and reserves all rights not expressly granted under these Terms of Use. EJLazenby Photography may modify, replace, or discontinue the Site or any part thereof at any time, for any reason, with or without notice, in EJLazenby’s sole discretion. EJLazenby Photography provides the Site on an "as is" and "as available" basis.
· All content on this Site, including but not limited to Images, Footage, and related metadata (collectively the "EJLazenby Photography Content"), as well as the selection and arrangement of the EJLazenby Photography Content, are protected by copyright and other intellectual property laws and treaties. Any unauthorized use of any EJLazenby Photography Content violates such laws and this Terms of Use.
Attribution is required upon publication/online use – EJLazenby Photography. This is compulsory and without discussion in all cases of usage.
There is a charge of £5.00 GBP for each high resolution download, It is at the discretion of EJLazenby Photography to release any offers or codes to users on an individual basis. Fees are payable at the time of download. If the downloaded file is incomplete, damaged or lost within a 30 day period, a substitute file may be requested if full image details are given. Please note, no refunds are offered after a file has been downloaded.

You acknowledge that you have read this agreement, understand it, and had an opportunity to seek independent legal advice prior to agreeing to it. In consideration of EJLazenby Photography agreeing to provide the content, you agree to be bound by the terms and conditions of this agreement as stated above. You further agree that it is the complete and exclusive statement of the agreement between you and EJLazenby Photography, which supersedes any proposal or prior agreement, oral or written, and any other communication between you and EJLazenby Photography relating to the subject of this agreement.
The buyer indemnifies and holds harmless EJLazenby Photography against all claims, liability, damages, costs and expenses stemming from a breach of this agreement, the use of the content, your failure to abide by any restriction regarding the use of the content, or any claim by a third party related to the use of the content.
The content is provided "as is" with no warranty regarding the suitability of the image for any purpose. EJLazenby Photography is not liable to the client or any person or entity for damages, costs or losses stemming from any usage of the content.
